General Terms and Conditions of Sale (GTC)

These terms and conditions govern sales made on the www.asterina.fr website, owned by Astérina.
1. PURPOSE:
These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of products offered by Astérina.
2. PRICES:
Prices are indicated in euros, inclusive of all taxes (TTC), excluding delivery costs.
Astérina reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed.
3. ORDER:
Any order placed on www.asterina.fr implies full and unreserved acceptance of these GTC.
The customer receives a confirmation email summarizing their order.
4. PAYMENT:
Payment is due immediately upon order. It can be made by credit card or any other secure method offered on the site.
Transactions are secured via our certified payment provider.
5. DELIVERY:
Orders are shipped 4 weeks after validation.
Delivery times vary depending on the destination and the carrier.
Astérina cannot be held responsible for delays caused by the carrier.
6. RIGHT OF WITHDRAWAL AND RETURNS:
In accordance with the law, the customer has a period of 14 days after receipt of the order to exercise their right of withdrawal, for a valid reason (defective product, product not delivered, product not the correct color).
Return costs are the responsibility of the customer. For more information, please consult our Return Policy.
7. LIABILITY:
Astérina cannot be held liable for indirect damages that may arise from the purchase of products.
Astérina's liability is limited to the amount of the order.
8. INTELLECTUAL PROPERTY RIGHTS:
All elements of the site (texts, visuals, logo, etc.) are the exclusive property of Astérina. Any reproduction, in whole or in part, is prohibited.
9. PERSONAL DATA:
The information collected is necessary for order management and to improve the customer experience.

10. APPLICABLE LAW:
These GTC are subject to French law.
In the event of a dispute, an amicable solution will be sought before any legal action.
11. LEGAL GUARANTEE OF CONFORMITY
In accordance with articles L217-1 et seq. of the Consumer Code and articles 1641 et seq. of the Civil Code
1. Legal guarantee of conformity
Astérina is obliged to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery.
In the event of a conformity defect, the consumer:
- Has a period of 2 years from the delivery of the goods to act;
- Can choose between the repair or replacement of the goods, subject to the cost conditions provided for in article L217-9 of the Consumer Code.
The legal guarantee of conformity applies independently of any commercial warranty that may be granted.
2. Legal guarantee against hidden defects
Astérina is also liable for the guarantee against hidden defects of the sold item that render it unfit for the use for which it was intended, or that diminish this use to such an extent that the buyer would not have acquired it, or would have given a lesser price for it, had they known about them.
In the event of a hidden defect, the consumer may:
- Act within 2 years from the discovery of the defect;
- Choose between the reimbursement of the price (redhibitory action) or the retention of the goods with full reimbursement (estimatory action).

APPENDIX – REFERENCE LEGAL TEXTS
Article L217-4 of the Consumer Code
The seller is obliged to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. They are also liable for conformity defects resulting from the packaging, assembly instructions, or installation when the latter was carried out by them under the contract or under their responsibility.
Article L217-5 of the Consumer Code
The goods conform to the contract: 1° If they are fit for the use ordinarily expected of similar goods and, where applicable: correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling; 2° Or if they present the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, brought to the seller's attention, and accepted by the latter.
Article L217-12 of the Consumer Code
The action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.
Article 1641 of the Civil Code
The seller is bound by the warranty against hidden defects in the sold item that render it unfit for the use for which it was intended, or that diminish this use to such an extent that the buyer would not have acquired it, or would have given a lesser price for it, had they known about them.
Article 1648, paragraph 1, of the Civil Code
The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.
12. EXERCISE OF THE RIGHT OF WITHDRAWAL:
In accordance with articles L221-18 et seq. of the Consumer Code, the consumer client has a period of 14 calendar days from the receipt of their order to exercise their right of withdrawal, without having to provide reasons or pay penalties.
To exercise this right, the client must notify Astérina of their decision to withdraw by any unambiguous written means (email to contact@asterina.fr or postal mail) before the expiration of the 14-day period. The client may use the standard withdrawal form provided for in article L221-5 of the Consumer Code, but this is not mandatory.
The product must be returned in its original condition, complete and unused, within 14 days following the communication of the decision to withdraw. Return shipping costs are the responsibility of the client.
Astérina will refund all sums paid (including initial delivery costs at the standard rate) within 14 days of receipt of the returned product or proof of shipment, using the same payment method as used for the order.
The right of withdrawal cannot be exercised for products made to the client's specifications or clearly personalized (Art. L221-28 of the Consumer Code).
